In the current context, Transfer Pricing regulations are becoming more stringent and preponderant for multinational companies since the application of these rules could affect the competitive and financial position of an organization. In the Latam region, the first Transfer Pricing regulations were issued in Mexico and Argentina, later and gradually, were incorporated in the other South American countries (with some exceptions). In Central America, the first legislation was pronounced in Panama in 2010, and in the following years, the other countries began to enact tax regulations on this issue.Regarding the methods used to determine the market value of intercompany transactions, most countries rely on the “OECD (Organization for Economic Co-operation and Development) Transfer Pricing Guidelines for Multinational Enterprises and Tax Administrations” which provide guidelines for the application of the “Arm’s Length Principle” that constitutes the international consensus on Transfer Pricing, i.e., on the valuation of international transactions among associated enterprises for tax purposes.TPC Group offers a services range related to intercompany transactions to clients throughout Latin America and Spain.
